This Privacy Policy explains how we collect, use, disclose, and safeguard your personal data when you access or use our platform at fundergo.ai (the "Platform") and the services provided thereon (the "Services").

By accessing or using the Platform, you acknowledge that you have read, understood, and agree to the collection and use of your personal data in accordance with this Privacy Policy. If you do not agree, please discontinue use of the Platform immediately.

• Financial and Business Data: Bank statements, financial reports, loan application details, income and expenditure information, audit reports, and transaction records uploaded to the Platform.
• Account Data: Login credentials (managed via third-party authentication), account preferences, and user role.
• Usage Data: IP address, browser type and version, pages visited, time and date of access, and other diagnostic data collected automatically.
• Communications Data: Any correspondence you send to us through the Platform or by email.

We do not knowingly collect personal data from individuals under the age of 18. If you are under 18, please do not use the Platform.

• Directly from you: When you register an account, complete an application form, upload documents, or contact us.
• Automatically: Through cookies, web beacons, and similar tracking technologies when you interact with the Platform.
• From third parties: Authentication providers, financial institutions, or business partners where permitted by law.

We collect and use your personal data for the following purposes under the PDPO Data Protection Principle 3:

• To provide, operate, and maintain the Platform and Services.
• To process loan applications and perform AI-assisted financial analysis.
• To verify your identity and prevent fraud, money laundering, and other unlawful activities.
• To communicate with you regarding your account, applications, and service updates.
• To comply with applicable legal obligations, including those under the Anti-Money Laundering and Counter-Terrorist Financing Ordinance (Cap. 615) and the Banking Ordinance (Cap. 155).
• To improve and personalise the Platform and develop new features.
• To conduct analytics and generate aggregated, anonymised insights.
• To enforce our Terms of Service and protect our legal rights.

We process your personal data on the following grounds:

• Contractual necessity: To perform our Services under a contract with you.
• Legal obligation: To comply with applicable laws and regulations in Hong Kong.
• Legitimate interests: To improve the Platform, prevent fraud, and ensure security.
• Consent: Where you have provided explicit consent for a specific processing activity.

7. Disclosure of Personal Data

We may disclose your personal data to:

• Authorised financial institutions and lenders in connection with your loan application, with your consent.
• Service providers and technology partners who assist us in operating the Platform (e.g., cloud hosting, AI processing, email delivery), bound by confidentiality obligations.
• Regulatory authorities and law enforcement bodies where required by law, court order, or other legal process.
• Professional advisers such as lawyers, auditors, and insurers in connection with our business operations.
• Successors in interest in the event of a merger, acquisition, or sale of all or substantially all of our assets.

We do not sell, rent, or trade your personal data to third parties for their marketing purposes.

8. Transfer of Data Outside Hong Kong

Some of our service providers may be located outside Hong Kong. Where we transfer your personal data outside Hong Kong, we take reasonable steps to ensure that such data receives an equivalent level of protection as required under the PDPO, including by implementing contractual safeguards with the recipients.

9. Data Retention

We retain your personal data for as long as necessary to fulfil the purposes for which it was collected, including to satisfy any legal, accounting, or regulatory requirements. In general:

• Account data is retained for the duration of your account and for up to 7 years thereafter.
• Financial and loan application data may be retained for up to 7 years to comply with applicable financial regulations.
• Usage and analytics data is retained for up to 2 years.

When personal data is no longer required, it is securely deleted or anonymised.

10. Security

We implement appropriate technical and organisational measures to protect your personal data against unauthorised access, accidental loss, destruction, or alteration. These measures include encryption in transit and at rest, access controls, and regular security reviews. However, no method of transmission over the internet is completely secure, and we cannot guarantee absolute security.

11. Your Rights under the PDPO

Under the Personal Data (Privacy) Ordinance, you have the right to:

• Access: Request a copy of the personal data we hold about you (a Data Access Request under section 18 of the PDPO).
• Correction: Request correction of inaccurate personal data (a Data Correction Request under section 22 of the PDPO).
• Opt-out of direct marketing: Withdraw consent to the use of your personal data for direct marketing purposes at any time.

To exercise any of these rights, please submit a written request to privacy@fundergo.ai. We will respond within 40 days as required under the PDPO. We reserve the right to charge a reasonable fee for processing Data Access Requests in accordance with the PDPO.

12. Cookies and Tracking Technologies

We use cookies and similar technologies to enhance your experience on the Platform, remember your preferences, and collect usage analytics. You may configure your browser to refuse all cookies or to alert you when cookies are being sent. However, disabling cookies may affect the functionality of certain parts of the Platform.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or applicable laws. We will notify you of material changes by posting the updated policy on the Platform with a revised "Last updated" date. Your continued use of the Platform after such changes constitutes your acceptance of the updated policy.
